Terms & Conditions — LARIÉTTE (English Translation)

0) Definitions

  • In stock: product available immediately in standard sizes.

  • Made to order (standard sizes): product not in stock, produced in standard sizes (no personalization based on the customer’s measurements).

  • Personalized (custom sizes): product made according to the customer’s measurements/specifications (e.g., circumferences, lengths, pattern/cut changes, materials).

  • Standard 6–20 days: production + delivery within 9–20 business days (free shipping).

  • Urgent 6–9 days: production + express delivery; additional fee of +50 lei (limited capacity).

  • Express Delivery 2–4 days: for in-stock products; delivery within 2–4 business days for orders placed by 12:00 EET/EEST.

  • Standard delivery: the cheapest shipping option displayed at checkout for the customer’s address (relevant for refunding outbound shipping in case of withdrawal under Romanian GEO No. 34/2014).

  • EET/EEST: Romania time zone (standard/daylight saving time).


1) Who we are

2) Scope & acceptance

These Terms apply to consumers (individuals) purchasing from lariette.ro. For B2B purchases, please contact us for separate terms. By placing an order, you confirm that you have read and accepted these Terms. Contracts are concluded in Romanian. (Romanian GEO No. 34/2014)


3) Product types

3.1. In stock (standard sizes) – available immediately.
3.2. Made to order (standard sizes) – produced in standard sizes, without personalization based on the customer’s measurements.
3.3. Personalized (custom sizes) – made according to the customer’s measurements/specifications.

Legal note: only personalized products fall under the exception to the right of withdrawal (Art. 16(c) – Romanian GEO No. 34/2014).


4) Prices, discounts & taxes

4.1. Prices are in RON and include 21% VAT.
4.2. Shipping costs & options are calculated and displayed during checkout after the delivery address and details are entered.
4.3. Discount transparency (Omnibus): for any reduced price, we indicate the lowest price applied in the last 30 days; for newly listed products (no price history), the reference price is the launch price; for progressive discounts, we continuously display the lowest price in the 30 days preceding the current discount.
4.4. Obvious errors (E&OE): in case of an obvious pricing/description error, we may cancel the order before shipping and refund all amounts paid.


5) Orders & contract conclusion

5.1. Orders can be placed on the website, by phone, WhatsApp, or email.
5.2. The confirmation email is informative; the contract is deemed concluded upon acceptance of the order (express confirmation and/or handover to the courier).
5.3. Refusal/cancellation – legal framework:

  • We may refuse an order before acceptance (e.g., payment not validated or reasonable fraud suspicion).

  • After acceptance, the contract may be terminated only in cases provided by law/contract (objective inability to deliver, obvious pricing/description error – E&OE, non-payment in case of advance payment), with full refund of amounts paid by the consumer.
    5.4. Invoices & email communications: invoices are issued automatically via Oblio and sent to the email entered with the order. If you did not enter an email address or entered it incorrectly, you will not receive notifications (confirmation, order status, invoice). In this case, contact us for clarification. Please also check Spam/Junk; if you entered an email but expect notifications on another, update your email in your account/communications.


6) Payment

6.1. Card (VISA/Mastercard/Maestro) or cash on delivery (Romania).
6.2. Card payments may be pre-authorized at order placement and captured upon acceptance/before shipping. We may request anti-fraud checks (e.g., phone confirmation).
6.3. COD fee: for cash on delivery in Romania, the courier charges an additional fee of 10 RON (displayed at checkout).


7) Delivery (Romania) & transfer of risk

7.1. Couriers: Urgent Cargus, FAN Courier, Sameday.
7.2. Timeframes & options (cut-off 12:00 EET/EEST):
a) In stock (standard sizes) – Express Delivery 2–4 business days for orders placed by 12:00.
b) Made to order (standard sizes) – Standard 9–20 days; Urgent 6–9 days (+50 lei; limited capacity; prior confirmation required).
c) Personalized (custom sizes) – Standard 9–20 days; Urgent 6–9 days (+50 lei; limited capacity; prior confirmation required).

If, for reasons attributable to us, we do not meet Urgent 6–9 days, we automatically refund the urgency fee (+50 lei); the remedies under §8 also remain available.

7.3. Costs & free shipping
Free shipping applies to the Standard 6–20 days option for products from 799 RON (made to order & personalized). For Express Delivery 2–4 days and Urgent 6–9 days, the fees displayed at checkout apply.

7.4. ETA displays: product/cart pages may display indicative ranges (e.g., “Arrives between Oct 06 – Oct 24”).
7.5. Transfer of risk: risk passes to the consumer upon receipt of the parcel. If you choose a carrier other than our options, risk transfers from the moment we hand the parcel over to the carrier selected by you.
7.6. Maximum legal deadline: if delivery does not take place within 30 days of contract conclusion (and you have not accepted an extension), you may terminate the contract; we will refund the amounts paid.


8) Event Date Guarantee

8.1. For made-to-order and personalized orders, where available, we confirm in writing a deadline date (Standard or Urgent). The event date may be evidenced by an invitation/contract/confirmation or another reasonable document.
8.3. Exclusions: force majeure; late or incorrect data/measurements provided; inability to contact the customer; other causes not attributable to us.


9) Right of withdrawal (14 days) — standard products

9.1. For in stock and made to order (standard sizes) you have a 14-day right of withdrawal from the date of delivery, without giving any reason.
9.2. How to exercise: any channel (email/WhatsApp/phone) is valid; for speed, we recommend contact@lariette.comwith the subject “Withdrawal + order no.”
9.3. Refunded amounts: product price + the cost of standard delivery to you; the extra fee paid for higher options (Express Delivery/Urgent) is not refunded.
9.4. Return shipping deadline: 14 days from the date of receiving the parcel; returns shipped after the deadline may be refused.
9.5. Return logistics: we do NOT accept returns sent to post offices, pick-up points/lockers, and we do NOT accept COD returns; send returns only to the address in §10.1.
9.6. Diminution in value for odor/marks/soiling
If the product has strong odor (sweat/perfume), dirt, pet hair, stains, makeup marks, damage, or signs of wear (e.g., worn to an event) and becomes unsuitable to be resold as “new”, we may apply a diminution in value of up to 100%.

  • The assessment is objective, with photos/a findings note communicated before refund.

  • If you do not accept the proposed deduction, we will ship the product back to you at your expense (no price refund).
    This does not affect the legal right of withdrawal; it reflects liability for diminished value.

9.7. Exception: personalized products cannot be returned (Art. 16(c) – Romanian GEO No. 34/2014).


10) Returns & refunds — procedure

10.1. Pack the item properly (ideally in the original packaging) and include your order number.

Invoice: available by email (also check spam); issued automatically via Oblio.

Please complete the return form and tick the box that best explains the reason for the return.

10.2. We do not accept parcels with “charges payable on delivery”; for international returns, any customs duties/taxes related to the return are borne by the customer.
10.3. Refunds are issued within 14 days of receiving the return or proof of shipment (we may postpone until physical receipt).


11) One free size exchange (1×)

11.1. One free size exchange is available if requested within 2 days of delivery, for:

  • in-stock items (standard sizes), and

  • made-to-order items (standard sizes), when the desired size is available.

11.2. Personalized products are not eligible, but can be altered for a fee (depending on complexity); we provide a quote in advance.
11.3. The item must be only tried on, with tags intact; visible damage/wear may lead to refusal of the exchange.
11.4. This benefit does not limit the legal right of withdrawal where applicable.


12) Promotional gifts

12.1. If a promotion conditions a gift on purchasing the main product, then upon returning the main product the gift must be returned unopened; otherwise, we deduct the displayed value of the gift from the refunded amount.
12.2. This rule applies only to promotions where the gift was explicitly conditioned on the purchase.
12.3. For sealed goods for hygiene reasons, legal exceptions may apply.


13) Personalized products (custom sizes)

13.1. The order becomes non-cancellable from the moment materials are purchased or production begins, evidenced by email/WhatsApp referencing the order. Before that moment, cancellation is possible with written confirmation.
13.2. Delivery timeframes: Standard 9–20 days; Urgent 6–9 days (+50 lei; limited capacity).
13.3. Execution conformity: for non-conformities attributable to LARIÉTTE (execution contrary to validated specifications), we apply the legal remedies in §14.
13.4. The customer is responsible for the accuracy of measurements/specifications provided; later changes may generate additional costs.


14) Legal guarantee of conformity

14.1. Products benefit from the legal guarantee under Romanian GEO No. 140/2021 (transposing Directive (EU) 2019/771).
14.2. 12-month presumption: non-conformities appearing within the first 12 months from delivery are presumed to have existed at delivery, except where incompatible with the nature of the goods/non-conformity.
14.3. Remedies: bringing into conformity (repair/replacement) within a reasonable time and free of charge; if not possible or disproportionate, you have the right to a price reduction or contract termination.
14.4. Prompt notice & evidence: please notify us as soon as you discover the issue and provide clear evidence (photo/description). This does not affect your legal rights (including the presumption in §14.2).
14.5. Digital elements (if applicable): we provide updates for the period required by law or within a reasonable time to maintain conformity.


15) Colors, sizes & particularities

Minor variations may occur in colors (screen settings) and dimensions (production tolerances). The size guide is fixed; we offer free WhatsApp guidance to help you choose the correct size.


16) Discounts & loyalty program

16.1. Discounts/promo codes cannot be combined, unless expressly stated.
16.2. Loyalty points may be used within the displayed limits; they expire 3 months from issuance. We may cancel points obtained due to technical error or fraud, with prior notice.
16.3. For any discount, we comply with the Omnibus 30-day rule.


17) Liability & force majeure

17.1. We do not exclude/limit liability in cases where the law does not allow it (e.g., personal injury, death, fraud).
17.2. We are not liable for delays/non-performance caused by force majeure (external, unforeseeable, unavoidable events).
17.3. These clauses do not affect your statutory rights under Romanian GEO No. 34/2014 and GEO No. 140/2021.


18) Assignment

We may assign/transfer rights and receivables; notice will be sent to the email used for the order, and if invalid, by SMS or post to the declared address. The assignment does not affect your consumer rights.


19) Dispute resolution

We aim to resolve disputes amicably (contact: contact@lariette.com, +40 743 078 080). You have access to ADR and the European ODR platform: https://ec.europa.eu/consumers/odr. Jurisdiction of Romanian courts is determined by law.


20) Intellectual property & UGC content

20.1. Website content (texts, images, trademarks, design, code) is protected by copyright and trademark law; commercial use without written consent is prohibited.
20.2. UGC (reviews/photos): by submitting content to LARIÉTTE, you grant us a non-exclusive, royalty-free, perpetual license to use it on the website and social channels, in compliance with privacy and GDPR.


21) Data protection

We process personal data in accordance with GDPR (Regulation (EU) 2016/679) and Law No. 190/2018. Please consult the Privacy Policy and Cookie Policy (separate documents available on the website).


22) Updates to these Terms

We may amend these Terms; the current version (dated above) applies to orders placed after publication on the website.
